The police officials had charged Singh with consuming heroin purchased from Kahlon and Kulwinder Singh “Rocky”.

The outcomes of his blood, urine and hair tests are awaited. There is no reference that any other evidence is to be accumulated.

Devinder Attri, station house officer of the ditrict, has registered a report that the functionaries had pressed charges against Singh under Section 27 (punishment for prohibited possession of small amount of drug for personal use) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act only for the moment.

The maximum punishment below the law is thorough detention up to 1 year or a penalty of around Rs. 20K or both.

Ram Singh’s advocates Mandeep Singh Bains and Jashandeep Singh forwarded in court that Section 27 of the NDPS Act was regarding sentence for having any illegal drug, and it was yet to be witnessed it could be relevant to any preceding consumption as well. Under schedule 2 of the Criminal Procedure Code (CrPC), taking heroin is a crime carrying custody of below 3 years or penalty, and the man charged can obtain bail and be tried in any court.

The CrPC has been made applicable to the proceeding before the special court as allowed under Section 36 (c) of the NDPS Act. However, Section 37(i) (a) of the law turns each crime under the NDPS Act cognizable, whilest the right to bail has been confined in Section 37(i)(b) pertaining to a few other rules and offence including commercial quantity. The counsel indicated that Section 37(i)(b) was not appropriate in the current case, since the blame against Singh for the moment was under a law, which was permissive.

The court has ordered Singh to be freed on bail on his furnishing a personal bond of Rs. 20K with like security to the agreement of the region magistrate.
